So, I have been silent because I am desperately trying to get ready for the start of class next week, when I begin teaching Trademark and do another round of Copyright. For Trademark, I'm going to try to make a sort of medley of songs/quotes using trademarks as cultural shorthand (a Mickey Mouse operation, etc.). I have a bunch of songs, but I was wondering if anyone could give me a sound clip of the following quote from "Fool for Love": "Look, I realize that every Slayer comes with an expiration mark on the package. But, I want mine to be a long time from now. Like a Cheeto."

I have no idea if this will work, but I'm going to try -- I've got lots of songs, like "Air Force Ones," "Where Have All the Cowboys Gone?" (Where is my Marlboro Man?), "Little Red Corvette," "Bad Touch," "Coca-Cola Cowboy," "Thank God and Greyhound You're Gone," etc. Any other suggestions would also be appreciated.

Barenaked Ladies' "One Week"

"Like Snickers - guaranteed to satisfy"

Ooh, nice. I was thinking of "If I had $1,000,000" with the Kraft Dinner line, but I might use "One Week" instead.

Damn straight. The sad thing is, they actually used it in a M-B commercial a few years back. I'd love to get footage of that commercial.

Either the Author's Guild or the Writer's Guild has been gathering examples of book titles that have trademarked terms used in them after the filing of Fox v. Franken -- it should be easy to find online either through Google or the usual suspects like Lessig.

From: [identity profile] rivkat.livejournal.com

Yeah, I've seen the list, though I have my own issues with the Author's Guild that make me less willing to wade through the large numbers of redundant and irrelevant posts. I do have wonderful pictures of the book covers -- Franken and O'Reilly both -- which I'm going to use. Though in general I'm going to try to coordinate image and sound, so "Marlboro man" with a picture of the guy, etc.

"Kodachrome" by Simon and Garfunkel. As I recall, Simon later said he'd never try to use a copyrighted reference again after all the hassle he got over this song.

Not sure if this counts, but there are a couple of fun brand name references in Cake's Short Skirt/Long Jacket:

I want a girl with smooth liquidation
I want a girl with the right dividends
At Citibank we will meet accidentally
We’ll start to talk when she borrows my pen

She wants a car with a cupholder armrest
She wants a car that will get her there
She’s changing her name
From Kitty to Karen
She’s trading her MG for a white Chrysler LeBaron
I want a girl with a short skirt and a long jacket

There's also a fun copyright refence in the Dandy Warhol's new album, on the song "Welcome to the Monkeyhouse"

Wire is coming back
Elastica got sued by them
When Michael Jackson dies
We're covering "Blackbird"
And won't it be absurd then
When no one knows what song they just heard
Unless someone on the radio tells them first

Billy Joel, "Big Shot"

You went uptown riding in your limousine
In your fine Park Avenue clothes
You had the Dom Perignon in your hand
And the spoon up your nose

. . .

They were all impressed with your Halston dress
And the people you knew at Elaine's
And the story of your latest success
Kept 'em so entertained

Janis Joplin, "Mercedes Benz"

Oh Lord, won’t you buy me a Mercedes Benz?
My friends all drive Porsches, I must make amends.
Worked hard all my lifetime, no help from my friends,
So Lord, won’t you buy me a Mercedes Benz?

And, of course, Bruce Springsteen's "Pink Cadillac."

Hope these help. :)

Thanks! For Billy Joel, I was thinking of using Pressure: "All your life is Channel 13/Sesame Street/What does it mean?"

I apparently have the one copy of FFL in the universe which has no sound. *kicks CD*

There's a number of 'Superman' sings, including 5 For Fighting's and Laurie Anderson's. You've already got billy joel so you don't need 'we didn't start the fire', and I'm not sure if the original of 'diamonds are a girl's best friend' mentions tiffany's and cartier, but the moulin rouge version does.

And which boyband did the song 'summertime girls,' which had a line that went, 'I like girls who wear abercrombie & fitch...'?

I was going to use Kryptonite, by 3 Doors Down, naturally. Good call on Abercrombie & Fitch, thanks!

Fountains of Wayne "Mexican Wine" (I used to fly for United Airlines/Then I got fired for reading High Times)

Fun project. Good luck with all that class prep!

Great. Now I just have to learn to use iMovie so I can make a music video medley. I have a huge number of Marlboro man pictures and parodies, so now I have to find pictures to go with all these others.

Apparently Eminem is a goldmine (http://www.snarkhunting.com/features/eminembrands.html) for songs with trademarks in them- and you know, Aqua's "Barbie Girl" could definitely be included, since there's actual case law supporting it!

From: [identity profile] rivkat.livejournal.com

Thanks for the link! "Barbie Girl" is being withheld for the day I'm teaching that case, late in the semester. I don't know if I'll be able to pull this off; I now wish I knew more about vidding.

I don't know much myself, but if I can help, please don't hesitate to ask, okay? Man, I wish I were in college, your courses sound fascinating!

As far as trademark goes, you might want to look at some rap songs--a lot of those artists seem to like to name-check pretty much everything they wear, drive, or drink.

Some songs:
My Girlfriend (Jay-Z & Beyonce) mentions Burberry

In those Jeans (Ginuwine) (mentions a whole lot of designers, baby phat being one of them. there's also a baby phat logo in the video)

Pass the Courvosier (P. Diddy, Pharrell, etc.)

PIMP (50 cent) mentions...oh, hell. Gucci, Fendi, Prada, BCBG, Burberry, Dolce & Gabbana and Mercedes Benz

The Jump Off (Lil' Kim) Mercedes Benz, Bacardi, Jaguar, Escalade, etc.

I Just Wanna Love You (Jay-Z) Motorola, and a whole bunch of designer names.

And that's just off the top of my head. I listen to too much rap.

Thanks! I ended up just putting a bit of rap in, though I may modify it over time for future presentations. I found a page that actually monitors brand mentions in the Billboard top 20, and I saw a bunch of those songs -- I even downloaded In Those Jeans.

I have a lot of respect for vidders now, much more than I did before.
